By accessing or using the AutomateRE platform, mobile application, browser extensions, APIs, and any related services (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our Services. By using AutomateRE, you represent and warrant that you meet these requirements.

3. Account Registration & Security

1. You must create an account and provide accurate, complete, and current information.
2. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3. You agree to notify us immediately of any unauthorized use or security breach.

4. Service Description

AutomateRE provides AI-powered automation tools tailored to real-estate professionals, including but not limited to:

• Virtual Assistant for lead response, scheduling, and CRM sync.
• SmartTour AI for QR/NFC open-house sign-ins and instant follow-ups.
• EasySocial AI for social-media content generation, scheduling, and analytics.

We may add, modify, or remove features at any time.

5. Fees & Payment

1. Some features require a paid subscription. Prices, billing cycles, and payment methods are disclosed at checkout.
2. All fees are non-refundable except as required by law or expressly stated.
3. Late payments may result in suspension or termination of your account.

6. License & Intellectual Property

1. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.
2. All intellectual-property rights in the Services, including software, branding, and content (except your own content), remain with AutomateRE LLC or its licensors.

7. User Content & Data

1. You retain ownership of content you upload or submit ("User Content"). You grant us a worldwide, royalty-free license to host, process, and display User Content solely to provide the Services.
2. You represent that you have all necessary rights and permissions to upload User Content.
3. We process personal data in accordance with our Privacy Policy.

The Services integrate with third-party platforms (e.g., Google, Microsoft, LinkedIn). Your use of such integrations is subject to each provider's terms. AutomateRE is not liable for third-party services or outages.

The Services are provided "as is" without warranties of any kind, whether express or implied. We do not guarantee accuracy of AI outputs, uninterrupted availability, or that the Services are error-free.

11. Limitation of Liability

To the fullest extent permitted by law, AutomateRE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities, arising from or related to the Services.

12. Indemnification

You agree to indemnify and hold harmless AutomateRE LLC, its officers, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

13. Termination

We may suspend or terminate your access at any time for violation of these Terms or to comply with legal obligations. Upon termination, your license to use the Services ceases immediately.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on our website or communicated via email. Continued use after changes become effective constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida.
